The Kenwood Village Conservation Easement resides entirely
within the Kenwood Village Subdivision. The easement is overlaid on the lots
located along the perimeter of the Kenwood Village Subdivision, meaning that
part of each perimeter lot is part of the conservation easement. Each perimeter
lot incorporates a 20’ foot wide strip along the rear of the lot extending
from the property line onto the lot that is considered the conservation
easement. There is no KVPOA responsibility for the conservation easement except
in those areas where the conservation easement borders on
Kenwood
Village
common area properties. The Conservation Easement is dedicated to the Board of
County Commissioners. However, each individual lot owner is responsible for the
portion of the easement that is on their property. Each individual lot owner is
responsible for the trees on their respective property. No
vegetation can be removed or planted within the Conservation Easement without
county approval. The only way an individual lot owner would be responsible
for removal of a dead tree from the conservation easement would be, if the tree
was posing a threat to their life/ property or to adjacent life/ or property.
Please keep in mind that a dead tree and limbs can fall in any direction.
Generally, it is easy to make a determination that a dead tree poses by
considering the height of the dead tree and the proximity to existing
structures.
KVPOA Board Recommendations:
Before proceeding with removing and/ or adding anything in
the Conservation Easement, contact the appropriate
Indian River
County
agency and request written permission to proceed. A good starting place would
be to contact the person and department mentioned in this correspondence.
Also, it is strongly recommended that each Kenwood Village property owner that
includes the conservation easement, should contact their homeowner insurance
provider to gain a clear understanding of their individual coverage and
liability potential.
